1. Acceptance of Terms

By accessing consultwithnewway.net or sales.consultwithnewway.net (the "Site"), purchasing a product, or enrolling in any service offered by NewWay Consulting LLC ("NewWay," "we," "us," or "our"), you agree to these Terms and Conditions. If you do not agree, do not use the Site or our services. Enrollment in credit repair services is also governed by a separate written Client Services Agreement, which controls if it conflicts with these Terms.

2. Credit Repair Organization Disclosure

NewWay Consulting LLC is a credit repair organization as defined by the federal Credit Repair Organizations Act (CROA), 15 U.S.C. § 1679 et seq. Before you sign any service agreement, we will provide you with the written disclosure "Consumer Credit File Rights Under State and Federal Law."

3. Your Rights

You have the right to dispute inaccurate information in your credit report by contacting the credit bureaus directly, at no cost. You are not required to hire a credit repair organization. You may cancel your Client Services Agreement without penalty or obligation within three (3) business days of signing it. Any waiver of your rights under CROA is void and unenforceable.

4. Services Offered

NewWay offers the following services, as described on the Site at the time of purchase:

  • Executive Credit Repair Package: three-bureau analysis, personalized action plan, dispute strategy across Experian, Equifax, and TransUnion, direct consultant support, priority escalation, and an extended structured program.
  • Priority Credit Repair Package: three-bureau analysis, personalized action plan, three-bureau dispute strategy, portal-based consultant support, and a 90-day structured program.
  • ChexSystems Removal: ChexSystems report analysis, custom dispute strategy, and banking readiness guidance over a 14-day service period.
  • DIY Dispute Letter Kit: a downloadable set of dispute letter templates and a self-guided instructional guide. This is a self-service product; no disputes are filed on your behalf.
  • Free Consultation: an optional 15–30 minute call. A consultation is not required to enroll and does not create a service agreement.

Dispute rounds are generally submitted every 30–45 days after onboarding is complete. Timelines are estimates and depend on bureau and creditor response times.

5. No Guarantee of Results

NewWay does not guarantee any specific outcome, deletion, or credit score increase. No company can lawfully remove accurate, current, and verifiable information from a credit report. We dispute only information you believe to be inaccurate, incomplete, outdated, or unverifiable. Client results shown on the Site reflect individual files and are not typical or guaranteed.

6. Client Responsibilities

To begin and continue services, you agree to:

  • Provide a valid government-issued ID, your Social Security card or number, and proof of address dated within 30 days. Services will not begin until all documents are received.
  • Maintain an active SmartCredit subscription (currently $39/month, billed by SmartCredit, not NewWay) for the duration of your program.
  • Provide truthful, accurate, and complete information. We will not assist with disputing information you know to be accurate, and we will never advise you to misrepresent your identity or create a new credit identity.
  • Forward all correspondence you receive from credit bureaus and creditors through your client portal promptly.
  • Avoid filing your own disputes on the same items during your program without notifying us, as duplicate disputes may be flagged as frivolous.

Delays caused by missing documents, lapsed monitoring, or unanswered requests do not extend our obligations and are not grounds for a refund.

7. Fees and Payment

Fees are listed on the Site and in your Client Services Agreement. In accordance with CROA, NewWay does not charge or collect payment for credit repair services before those services have been fully performed. Buy Now, Pay Later options (Klarna, Afterpay, Zip, Cash App Pay, and Amazon Pay) are provided by third parties and are subject to their own terms; NewWay is not responsible for those providers' fees, approvals, or collection practices.

8. Cancellation and Refunds

You may cancel within three (3) business days of signing your Client Services Agreement for a full refund of any amount paid. After that period, you may cancel at any time by written notice through your client portal or at [email protected]. You will not be charged for services not yet performed. 9. Digital Products

The DIY Dispute Letter Kit is delivered as an instant download. Because digital content cannot be returned once accessed, all sales of downloadable products are final after download, except where required by law. The kit is licensed for your personal use only and may not be resold, shared, or redistributed.

10. Third-Party Services

Our services rely on third parties including SmartCredit, the credit bureaus, ChexSystems, and payment providers. NewWay is not responsible for their actions, errors, outages, or policies.

11. Communications and Text Messaging

By providing your phone number and email, you consent to receive calls, text messages, and emails from NewWay about your account, services, and promotions, including messages sent using automated technology. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help.

12. Privacy and Data Security

We collect sensitive personal information, including your Social Security number, identification, and credit data, solely to provide our services. We use reasonable safeguards to protect it and do not sell your personal information. See our Privacy Policy for details.

13. Not Legal or Financial Advice

Our services and educational content are provided for credit consulting and educational purposes only. NewWay is not a law firm, does not provide legal advice, and is not a financial advisor. Consult a licensed professional for legal, tax, or investment advice.

14. Intellectual Property

All content on the Site, including text, graphics, logos, templates, and materials, is owned by NewWay Consulting LLC and protected by law. You may not copy, reproduce, or distribute it without written permission.

15. Limitation of Liability

To the fullest extent permitted by law, NewWay's total liability for any claim related to our services shall not exceed the amount you paid to NewWay for those services. NewWay is not liable for indirect, incidental, or consequential damages, including denied credit applications or lost opportunities. Nothing in these Terms limits any right you have under CROA or other applicable law.

16. Indemnification

You agree to indemnify NewWay against claims arising from false information you provide or your violation of these Terms.

17. Governing Law

These Terms are governed by the laws of the State of Mississippi and applicable federal law, without regard to conflict-of-law principles.

18. Changes to These Terms

We may update these Terms at any time. Changes take effect when posted to the Site. Your signed Client Services Agreement will not be changed without your written consent.
